Abstract: Section 23(b) of the Federal Power Act requires that a person wishing to construct project works on a navigable commerce clause water must file a declaration of their intention ("DI") to do so with the Commission. Section 23(b) further provides for the Commission to investigate the proposed construction to determine use.
