Sections 2723 and 2761 of the Public Health Service Act (PHS Act) direct the Centers for Medicare and Medicaid Services (CMS) to enforce a provision (or provisions) of title XXVII of the PHS Act (including the implementing regulations in parts 144, 146, 147, and 148 of title 45 of the Code of Federal Regulations) with respect to health insurance issuers when a state has notified CMS that it has not enacted legislation to enforce or that it is not otherwise enforcing a provision (or provisions) of the group and individual market reforms with respect to health insurance issuers, or when CMS has determined that a state is not substantially enforcing one or more of those provisions. This collection of information includes requirements that are necessary for CMS to conduct compliance review activities.
The estimated burden related to form filing submissions has decreased by 35 hours (from 364 to 329) due to the reduction in the estimated number of issuers (from 52 to 47) that submit forms for CMS’ review. The estimated burden related to full disclosure by issuers to all small employers of materials on all products and other information has decreased by 92 hours (from 774 to 682) due to a reduction in the estimated number of issuers affected by this requirement (from 387 to 341). The estimated burden related to opt-out notices has increased by 30 hours (from 145 hours to 175 hours) due to an increase in the estimated number of plans opting out (from 290 to 350). The burden related to state engagement coordination has increased by 162.5 hours (from 437.5 to 600) due to an increase in the burden per response (from 2.5 to 3) and an increase in the estimated number of responses (from 175 to 200). Therefore, total burden hours have increased by 65.5 hours (from 1720.5 to 1786).
