PROPOSED RULE - 10 CFR Parts 30 and 32, Items Containing Byproduct Material Incidental to Production
Part 32 of Title 10 of the Code of Federal Regulations (10 CFR), establishes requirements for specific licenses for the introduction of byproduct material into products or materials and transfer of the products or materials to general licensees, or persons exempt from licensing, medical use product distributors to specific licensees, and those requesting a certificate of registration for a sealed source and/or device. It also prescribes requirements governing holders of the specific licenses. This proposed rule would amend 10 CFR part 30 to add a new class exemption from licensing requirements for items containing byproduct material incidental to their production and amend 10 CFR part 32 to add new sections for distribution requirements.
The NRC is proposing to amend its regulations in Part 32 to add requirements for the exempt distribution of items containing byproduct material incidental to production (ICBMIP). This rulemaking would create a new class exemption for ICBMIP and requires initial distributors to obtain an initial exempt distribution license. The burden has would increase by 714 hours (630 hours reporting + 9 hours recordkeeping + 75 hours third party disclosure) from 137,650 hours to 138,364 hours.
