FORM 7-21SUMM-R 2014 Instructions INSTRUCTIONS FOR DISTRICT SUMMARY OF REPORTING AND DECLARATION FORMS (7-13) Bureau of Reclamation Do not use this form after December 31, 2014 OMB Control No.: 1006-0006 Paperwork Reduction Act This information is being collected to establish landholder compliance with Federal reclamation law. Response to this request is mandatory in accordance with Public Law 97-293 and 43 CFR 426.18. Public reporting burden for this form is estimated to average 40 hours per response, including time for reviewing instructions, gathering and maintaining data, and completing and reviewing the form. An agency may not conduct or sponsor, and a person is not required to respond to, a collection of information unless it displays a currently valid Office of Management and Budget (OMB) control number. GENERAL INFORMATION The “District Summary of Reporting and Declaration Forms” (Form 7-21SUMM-R) are used to tabulate and summarize the Reclamation Reform Act of 1982 (RRA) reporting forms submitted to this district by individuals, entities, and religious or charitable organizations subject to prior law; and declaration forms submitted by trusts, estates, public entities, and farm operators located in prior law districts. The landholder (direct or indirect owner or lessee) information and that of certain farm operators is tabulated on the appropriate tabulation sheets as follows: • Tabulation A – provide information pertaining to individuals and entities who hold (own or lease) land directly • Tabulation B – provide information pertaining to trusts and estates that hold land directly • Tabulation C – provide information pertaining to public entities that hold land directly • Tabulation D – provide information pertaining to religious or charitable organizations that hold land directly • Tabulation E – identify errors, omissions, or discrepancies related to landholders and farm operators • Tabulation F – this optional form is used to provide information pertaining to landholders who only hold land indirectly • Tabulation G – provide information pertaining to farm operators and part owners of farm operators required to file Form 7-21FARMOP The summary form also summarizes information regarding landholders in your district who are below the RRA forms submittal threshold or who are above the RRA forms submittal threshold and have not filed a form for the current water year. You must annually submit an original Form 7-21SUMM-R. Districts delivering any Reclamation irrigation water must also submit tabulation sheets reflecting all landholders over the RRA forms submittal threshold. Districts that do not anticipate delivering any Reclamation irrigation water during this water year must complete items 1-5, 13, and 14 of Form 7-21SUMM-R. Additionally, if Reclamation irrigation water deliveries commence after the summary form is submitted, a new summary form with the appropriate tabulation sheets must be submitted within 30 days of the date Reclamation irrigation water deliveries commenced. Any changes in the excess or full-cost acreage appearing on Form 7-21SUMM-R must be certified to us within 30 calendar days after the landholder reports the change to this district. Type or print all answers in ink. You must initial and date any crossouts and corrections. District name abbreviation(s) used on this form must be spelled out on the form where the abbreviation is used for the first time, or on a separate sheet attached to this form. Reclamation retains your district’s summary forms as a permanent record of RRA administration. You must complete various tabulations before you complete the main summary form. Use as many of the tabulations as necessary to tabulate all of the information. You do not need to submit a particular tabulation if your district does not have any landholders to list on that tabulation. For instance, you do not need to submit a Tabulation C for this water year if no public entities report their landholdings to your district this year. However, you must properly complete tabulation sheets for all landholder forms received even if the landholder in question does not receive Reclamation irrigation water in your district. Placement of a landholder on a tabulation sheet is based on the landholder or farm operator’s westwide landholdings (directly or indirectly owned or leased). However, in completing the appropriate tabulation sheets, only the acres in this district are to be included. The land that the landholders should be reporting is “irrigable land” and “irrigation land.” See “General Information About RRA Forms” (Form 7-21INFO) for the definitions of “irrigable land,” “irrigation land,” and “irrigation water.” Other terms and corresponding definitions that are specific to the RRA forms are: 2. • “Land” or “acres” means irrigable or irrigation land. Enter the following information for each direct landholder whose westwide landholding size fits in the category designated in item 1: (a) The name of the direct landholder. • “You” means the authorized district official completing this form for the district. (b) Check this box if the landholder holds land in more than one district. • “We,” “us,” “our,” or “Reclamation” means the Bureau of Reclamation. (c) The total number of acres in this district that the landholder directly owns. Obtain this information from item 20 of Form 7-2190, item 8 of Form 7-2190EZ, or item 21 of Form 7-2191. Visit www.usbr.gov/rra for more information. (d) The total number of acres in this district that the landholder directly leases. Obtain this information from item 23 of Form 7-2190, item 11 of Form 7-2190EZ, or item 24 of Form 7-2191. TABULATION A (INDIVIDUAL AND ENTITY REPORTING FORMS) Use Tabulation A to tabulate information for directly held (owned or leased) land from the following types of forms submitted to this district if this district or the landholder is subject to the prior law provisions: • “Report of Individual's Landholdings” (Form 7-2190), • “EZ Report of Individual's Landholdings” (Form 7-2190EZ), and • “Report of Entity's Landholdings” (Form 7-2191). (e) Enter the total number of acres in this district that the landholder directly owns that are designated as excess as identified on their “Designation of Excess Land” (Form 7-21XS). Obtain this information from item 11(e) of Form 7-21XS. (f) Enter the total number of acres in this district that the landholder directly holds and for which the full-cost rate will be paid. Obtain this information from item 14(c) of Form 7-21FC. If the landholder submitted a “Verification of Landholdings” (Form 7-21VERIFY), use the last standard form that was submitted by the landholder to obtain the information. You do not need to identify on Tabulation A which form was used to obtain this information. You may need to complete up to three different types of Tabulation A’s for various sizes of westwide landholdings: • One for landholdings that total more than 40 acres through 160 acres; • One for landholdings that total more than 160 acres through 320 acres; and • One for landholdings that total more than 320 acres. Note: To avoid double counting full-cost acres, only include full-cost acres for which the full-cost rate will be paid with the name of the landholder paying the full cost. You do not have to prepare a Tabulation A for a particular westwide landholding range if you do not have any landholders with that range to summarize (e.g., over 320 acres). Enter the total number of acres for each column on this page as indicated. 4. Enter the total number of entries corresponding with each column as indicated. For example, enter the total number of landholders listed on this page in item 4(a); enter the total number of times the multidistrict box was checked on this page in item 4(b); enter the total number of landholders listed on this page that directly own land in item 4(c); etc. TABULATION B (TRUST OR ESTATE DECLARATION FORMS) Use Tabulation B to tabulate information for directly held (owned or leased) land from the “Declarations of Trust’s or Estate’s Landholdings” (Form 7-21TRUST) submitted to this district if this district is subject to the prior law provisions. Use the last standard form that was submitted by the trust or estate to obtain the information if the trust or estate submitted a Form 7-21VERIFY. You may need to complete the following three different types of Tabulation B’s for the following sizes of westwide landholdings: RRA forms submitted by landholders whose westwide landholdings are below your district’s RRA forms submittal thresholds should not be tabulated here. Include information from such RRA forms in item 12 of Form 7-21SUMM-R. Enter this district’s name in the block provided at the top of the page. 1. 3. Use Tabulation C to tabulate information for directly held (owned or leased) land from the “Declaration of Public Entity’s Landholdings” (Form 7-21PE) submitted to this district if this district or the landholder is subject to the prior law provisions. Use the last standard form that was submitted by the public entity to obtain the information if the public entity submitted a Form 7-21VERIFY. Enter this district’s name in the block provided at the top of the page. 2. Enter the total number of entries corresponding with each column as indicated. For example, enter the total number of trusts and estates listed on this page in item 4(a); enter the total number of times the multidistrict box was checked on this page in item 4(b); enter the total number of trust and estates listed on this page that directly own land in item 4(c); etc. TABULATION C (PUBLIC ENTITY DECLARATION FORMS) RRA forms submitted by landholders whose westwide landholdings are below your district’s RRA forms submittal thresholds should not be tabulated here. Include information from such RRA forms in item 12 of Form 7-21SUMM-R. 1. Note: To avoid double counting full-cost acres, only include full-cost acres for which the full-cost rate will be paid with the name of the landholder paying the full cost. Enter the total number of acres for each column on this page as indicated. RRA forms submitted by landholders whose westwide landholdings are below your district’s RRA forms submittal thresholds should not be tabulated here. Include information from such RRA forms in item 12 of Form 7-21SUMM-R. Check the box that indicates the size of westwide landholdings appearing on this Tabulation B. If a trust or estate has not submitted an RRA form, you should include its landholdings on Tabulation E or in item 12 of the main summary form. Enter this district’s name in the block provided at the top of the page. Enter the following information for each trust or estate that directly holds land and whose westwide landholding size fits in the category designated in item 1: 1. (d) The total number of acres in this district that the trust or estate directly leases. Obtain this information from item 23 of Form 7-21TRUST. (d) Enter the total number of acres in this district that the public entity directly owns that are leased to or operated by other parties. Obtain this information from item 38 of Form 7-21PE. (e) Enter the total number of acres in this district that the trust or estate directly owns that are designated as excess as identified on their Form 7-21XS. Obtain this information from item 11(e) of Form 7-21XS. (e) The total number of acres in this district that the public entity directly owns and that is subject to application of the acreage limitation provisions. This is the directly owned acres that are used for other than specified purposes (as explained in item 16 and listed in item 17 of Form 7-21PE) and for all or a portion of which the public entity receives revenue. Obtain this information from item 39 of Form 7-21PE. (f) Enter the total number of acres in this district that the trust or estate directly holds and for which the fullcost rate will be paid. Obtain this information from item 14(c) of Form 7-21FC. 3 FORM 7-21SUMM-R (2014) (f) The total number of acres in this district that the public entity directly leases and that is subject to application of the acreage limitation provisions. This is the directly leased acres that are used for other than specified purposes (as explained in item 16 and listed in item 17 of Form 7-21PE) and for all or a portion of which the public entity receives revenue. Obtain this information from item 40 of Form 7-21PE. (b) Check this box if the religious or charitable organization holds land in more than one district. (c) The total number of acres in this district that the religious or charitable organization directly owns. Obtain this information from item 21 of Form 7-2194. (d) The total number of acres in this district that the religious or charitable organization directly leases. Obtain this information from item 24 of Form 7-2194. (g) Enter the total number of acres in this district that the public entity directly owns that are designated as excess as identified in item 41 of Form 7-21PE. (e) Enter the total number of acres in this district that the religious or charitable organization directly owns that are designated as excess as identified on their Form 7-21XS. Obtain this information from item 11(e) of Form 7-21XS. (h) Enter the total number of acres in this district that the public entity directly holds and for which the full-cost rate will be paid. Obtain this information from item 42 of Form 7-21PE. (f) Enter the total number of acres in this district that the religious or charitable organization directly holds and for which the full-cost rate will be paid. Obtain this information from item 14(c) of Form 7-21FC. Note: To avoid double counting full-cost acres, only include full-cost acres for which the full-cost rate will be paid with the name of the landholder paying the full cost. 2. Enter the total number of acres for each column on this page as indicated. 3. Enter the total number of entries corresponding with each column as indicated. For example, enter the total number of public entities listed on this page in item 3(a); enter the total number of times the multidistrict box was checked on this page in item 3(b); enter the total number of public entities listed on this page that own acreage in this district and do not lease that acreage to another party in item 3(c); etc. Note: To avoid double counting full-cost acres, only include full-cost acres for which the full-cost rate will be paid with the name of the landholder paying the full cost. 2. For example, enter the total number of religious or charitable organizations listed on this page in item 3(a); enter the total number of times the multidistrict box was checked on this page in item 3(b); enter the total number of religious or charitable organizations listed on this page that directly own land in item 3(c); etc. TABULATION D (RELIGIOUS OR CHARITABLE ORGANIZATION REPORTING FORMS) Use Tabulation D to tabulate information for directly held (owned or leased) land from the “Report of Religious or Charitable Organization's Landholdings” (Form 7-2194) submitted to this district if this district or the landholder is subject to the prior law provisions. Use the last standard form that was submitted by the religious or charitable organization to obtain the information if the religious or charitable organization submitted a Form 7-21VERIFY. TABULATION E (ERRORS, OMISSIONS, AND DISCREPANCIES) You must report the information on the summary form exactly as the landholders have reported it. However, this district has the responsibility to report known errors, omissions, and discrepancies found on the landholder forms to us on Tabulation E. RRA forms submitted by landholders whose westwide landholdings are below your district’s RRA forms submittal thresholds should not be tabulated here. Include information from such RRA forms in item 12 of Form 7-21SUMM-R. Enter this district’s name in the block provided at the top of the page. 1. Enter this district’s name in the block provided at the top of the page. 1. Enter the following information for each religious or charitable organization that directly holds land: Enter the following information for each direct landholder who holds land over the RRA forms submittal threshold requiring reporting, that did not receive Reclamation irrigation water, and that did not submit a form. (a) The name of the landholder. (a) The name of the religious or charitable organization. 4 FORM 7-21SUMM-R (2014) (b) Enter the acres held by each landholder in this district. Obtain this information from the last submitted standard form or other available information. 2. (c) Check this box if the part owner holds land in more than one district. (d) Indicate if the part owner directly owns or leases land in the part owner's name in this district. If the answer is “yes,” the part owner does not belong on Tabulation F. Instead, the part owner should be listed on the applicable Tabulation A-E. For example, John Smith leases 100 acres and owns 50 acres through Smith Farms. As such, he would be listed on Tabulation A with 100 acres leased. Mr. Smith’s indirect landholdings would not be shown. Enter the following information for each direct landholder who holds land over the RRA forms submittal threshold that received Reclamation irrigation water, and that did not submit an RRA form. (a) The name of the landholder. (b) Enter the acres held by each landholder in this district. 3. (c) Provide a reason or explanation as to why the water was delivered to the land in question without an RRA form on file. (e) The total number of acres in this district that the part owner indirectly owns. Obtain this information from item 21 of Form 7-2190, item 22 of Form 7-2191, item 22 of Form 7-2194, or item 21 of Form 7-1TRUST. Enter the following information for each direct landholder who holds land over the RRA forms submittal threshold requiring reporting, that submitted a form that has an error, omission, or discrepancy. (Note: These landholders should also be listed on the applicable Tabulation A-D.) Do not include the names of landholders who have corrected their errors, omissions, or discrepancies. (f) The total number of acres in this district that the part owner indirectly leases. Obtain this information from item 24 of Form 7-2190, item 25 of Form 7-2191, item 25 of Form 7-2194, or item 24 of Form 7-21TRUST. (g) Enter the total number of acres in this district that the part owner indirectly owns that are designated as excess as identified on their Form 7-21XS. Obtain this information from item 13(e) of Form 7-21XS. (a) The name of the landholder. (b) Indicate if the landholder received Reclamation irrigation water. (h) Enter the total number of acres in this district that the part owner indirectly holds and for which the full-cost rate will be paid. Obtain this information from item 16(e) of Form 7-21FC. (c) Briefly explain the error, omission, or discrepancy. TABULATION F (PART OWNERS) This tabulation sheet has been included for this district's convenience. This district is not required to fill out this tabulation, and no adverse consequences will result from not submitting this tabulation. However, completion of this tabulation is recommended to aid both us and this district. Tabulation F is to assist you in identifying part owners who hold land only indirectly in this district. If a part owner directly owns or directly leases any land, that part owner does not belong on this tabulation sheet and should be placed on Tabulation A – E, as applicable. 2. Enter the total number of acres for each column on this page as indicated. 3. Enter the total number of entries corresponding with each column as indicated. For example, enter the total number of landholders listed on this page in item 3(a); enter the total number of times the multidistrict box was checked on this page in item 3(b); enter the total number landholders listed on this page that indirectly own land in item 3(c); etc. Enter this district’s name in the block provided at the top of the page. TABULATION G (FARM OPERATOR DECLARATION FORMS) 1. Enter the following information for each landholder who indirectly holds land in this district and does not directly hold any land in this district (these landholders will be referred to as part owners): Use Tabulation G to tabulate information from the “Declaration of Farm Operator Information” (Form 7-21FARMOP), if your district is subject to the prior law provisions. (a) Name of the part owner. Enter this district’s name in the block provided at the top of the page. (b) Name of the entity, trust, or estate that directly holds the land. 1. 5 Enter the following information for each farm operator (operator): FORM 7-21SUMM-R (2014) (a) Name of the operator OR the name of a part owner of a farm operator. Obtain this information from item 1 of Form 7-21FARMOP. All Forms 7-21FARMOP must be accounted for on this tabulation sheet. 6. (b) Check the box that indicates if the person or entity is an operator OR a part owner of a farm operator. (a) Total number of landholders. Obtain this information from item 4(a) of the Tabulation A's. (c) Check this box if the operator provides services to land in more than one district. (b) Total number of individuals and entities that directly own land in this district. Obtain this information from item 4(c) of the Tabulation A's. (d) The total number of acres in your district to which the operator provides services. Obtain this information from item 16 of Form 7-21FARMOP. 2. Enter the total number of acres in this column on this page. 3. Enter the total number of entries corresponding with each column as indicated. (c) Total number of acres that are directly owned in this district. Obtain this information from item 3(a) of the Tabulation A's. (d) Total number of landholders who directly lease land in this district. Obtain this information from item 4(d) of the Tabulation A's. INSTRUCTIONS FOR COMPLETING THE SUMMARY OF TABULATION SHEETS (e) Total number of acres that are directly leased in this district. Obtain this information from item 3(b) of the Tabulation A's. After you have completed all the tabulations, summarize them on Form 7-21SUMM-R. 1. Enter this district’s name. 2. Enter the total number of pages submitted including this page. 3. Enter the Reclamation project, unit, and/or division name. 4. Enter the Reclamation region in which this district is located. You may abbreviate as follows: Name of Region Great Plains Region Lower Colorado Region Mid-Pacific Region Pacific Northwest Region Upper Colorado Region (f) Total number of landholders who directly own excess acres in this district. Obtain this information from item 4(e) of the Tabulation A's. (g) Total number of excess acres that are directly owned in this district. Obtain this information from item 3(c) of the Tabulation A's. (h) Total number of landholders who directly hold fullcost acreage in this district. Obtain this information from item 4(f) of the Tabulation A's. Abbreviation GP LC MP PN UC (i) Total number of full-cost acres that are directly held in this district. Obtain this information from item 3(d) of the Tabulation A's. 7. 5. Summarize all of the Tabulation A's that you have completed by entering the following information for each size of westwide landholding. Do not include those landholders who hold land below the RRA forms submittal threshold and who still submitted a reporting form; instead, include these landholders in item 12. Check the box that indicates: (a) Your district is a category 2 district, because a prior law district is always a category 2 district. Summarize all of the Tabulation B’s that you have completed by entering the following information for each size of westwide landholding: (a) Total number of trusts and estates. Obtain this information from item 4(a) of the Tabulation B's. (b) Your district’s anticipation to deliver Reclamation irrigation water during the current water year. If the answer to this question is “no,” then submit the summary form with items 1-5 and 13 and 14 completed (no tabulation sheets are required). However, if Reclamation irrigation water deliveries commence after the summary form is submitted within the current water year, a new summary form with all appropriate tabulation sheets must be submitted within 30 days of the date Reclamation irrigation water deliveries commenced. (b) Total number of trusts and estates that directly own land in this district. Obtain this information from item 4(c) of the Tabulation B's. (c) Total number of acres that are directly owned in this district. Obtain this information from item 3(a) of the Tabulation B's. 6 FORM 7-21SUMM-R (2014) (d) Total number of trusts and estates that directly lease land in this district. Obtain this information from item 4(d) of the Tabulation B's. (h) Total number of public entities that directly hold full-cost acreage in this district. Obtain this information from item 3(h) of the Tabulation C's. (e) Total number of acres that are directly leased in this district. Obtain this information from item 3(b) of the Tabulation B's. (i) Total number of full-cost acres that are directly held in this district. Obtain this information from item 2(f) of the Tabulation C's. (f) Total number of trusts or estates that directly own excess acres in this district. Obtain this information from item 4(e) of the Tabulation B's. 9. (g) Total number of excess acres that are directly owned in this district. Obtain this information from item 3(c) of the Tabulation B's. (b) Total number of religious or charitable organizations that directly own land in this district. Obtain this information from item 3(c) of the Tabulation D's. (h) Total number of trusts and estates that directly hold full-cost acreage in this district. Obtain this information from item 4(f) of the Tabulation B's. (c) Total number of acres that are directly owned in this district. Obtain this information from item 2(a) of the Tabulation D's. (i) Total number of full-cost acres that are directly held in this district. Obtain this information from item 3(d) of the Tabulation B's. 8. Summarize all of the Tabulation D’s that you have completed by entering the following information: (a) Total number of religious or charitable organizations. Obtain this information from item 3(a) of the Tabulation D's. (d) Total number of religious or charitable organizations that directly lease land in this district. Obtain this information from item 3(d) of the Tabulation D's. Summarize all of the Tabulation C’s that you have completed by entering the following information: (e) Total number of acres that are directly leased in this district. Obtain this information from item 2(b) of the Tabulation D’s. (a) Total number of public entities. Obtain this information from item 3(a) of the Tabulation C’s. (b) Total number of public entities that directly own land in this district and that do not lease it to other parties. Obtain this information from item 3(c) of the Tabulation C’s. (f) Total number of religious or charitable organizations that directly own excess acres in this district. Obtain this information from item 3(e) of the Tabulation D's. (g) Total number of excess acres that are directly owned in this district. Obtain this information from item 2(c) of the Tabulation D's. (c) Total number of acres that are directly owned by public entities in this district and are not operated by or leased to other parties. Obtain this information from item 2(a) of the Tabulation C’s. (h) Total number of religious or charitable organizations that directly hold full-cost acreage in this district. Obtain this information from item 3(f) of the Tabulation D's. (d) Total number of public entities that directly lease FROM other parties in this district that are subject to the acreage limitation provisions. Obtain this information from 3(f) of the Tabulation C's. (i) Total number of full-cost acres that are directly held in this district. Obtain this information from item 2(d) of the Tabulation D's. (e) Total number of acres the public entity directly leases FROM other parties in this district that are subject to the acreage limitation provisions. Obtain this information from 2(d) of the Tabulation C's. 10. This item requests information about landholders who hold land above the RRA forms submittal threshold but, for whatever reason, have not submitted RRA forms. Obtain this information from Tabulation E, the last submitted standard forms, or other available sources. Districts that did not collect any RRA forms from the district’s landholders during this water year must complete this item if the district anticipates water delivery this year by answering “yes” to item 5(b). (f) Total number of public entities that directly own excess acres in this district. Obtain this information from item 3(g) of the Tabulation C's. (g) Total number of excess acres that are directly owned in this district. Obtain this information from item 2(e) of the Tabulation C’s. (c) Total number of acres directly owned by landholders who are below the RRA forms submittal threshold. You may estimate this number if this information is not available to you. (b) Total number of nonreporting landholders who directly own land in this district. Obtain this information from items 1(a) and 2(a) of the Tabulation E’s. (d) Total number of landholders who directly lease land but are below the RRA forms submittal threshold. You may estimate this number if this information is not available to you.
