The Commission needs to collect, compile and maintain a list of counties, Public Safety Answering Points (PSAP) service areas, and specific parts for public safety awareness of areas where wireless carriers are unable to comply with requirements for location accuracy concerning the ability of PSAPs to determine the location of emergency wireless 911 calls. The Commission also needs to ensure that wireless carriers and third party systems service providers transport confidence and uncertainty data for the location of wireless E911 calls to PSAPs on a per-call basis upon a PSAP's request (two years after the effective date of the Second Report and Order, FCC 10-176).
The Commission is submitting a revision due to adoption of the Third Report and Order, FCC 11-107. With the Third Report and Order, the Commission adopts a rule, providing that new CMRS network providers, meeting the definition of covered CMRS providers in Section 20.18 of the Commission's rules and deploying networks subsequent to the effective date of the Third R&O that are not an expansion or upgrade of an existing CMRS network must meet the handset-based location accuracy standard from the start. The rule requires new CMRS providers launching new stand-alone networks during the eight-year implementation period for handset-based CMRS wireless licensees to meet the applicable handset-based location accuracy standard in effect at the time of deployment. As a result, under the new rule section adopted by the Third R&O, all new CMRS providers in delivery emergency calls for Enhanced 911 service, must satisfy the handset-based location accuracy standard at either a county-based or Public Safety Answering Point (PSAP)-based geographic level. Similarly, in accordance with the new rule and under he paragraph provision of Section 20.18(h)(2)(iii), new CMRS providers may exclude up to 15 percent of the counties or PSAP areas they serve due to heavy forestation that limits handset-based technology accuracy in those counties or areas.

The Commission initially estimated this new collection with 71,100 total annual burden hours in March 2011. Now we are reporting a decrease in burden, i.e., respondents, responses and total burden hours. The Commission is reporting a 17,948 program change decrease. With a change in requirements in the Third Report and Order, FCC 11-107, the Commission includes providers of new CMRS networks in its compilation and maintenance of a list of counties and Public Safety Answering Points (PSAPs) service areas for public safety awareness of areas where CMRS wireless carriers are unable to comply with requirements for location accuracy.
