Abstract: Per Final Rule 0648-AX47, in the event that the arbitration organizations representing at least 50 percent of the processor quota share (PQS) holders, and at least 50 percent of the unaffiliated QS, holders agree that a fishery is unlikely to open, neither a market report nor non-binding formula will be required for the fishery. Any such agreement will include provision for the production of the market report and non-binding formula, in the event that an opening is later announced for a fishery, specifying a timeline for the production of those reports. No change to burden or cost is being estimated at this time, though minor savings may occur.

Short Statement: This action is a revision/renewal with program changes and adjustments. NMFS has changed the Arbitration information collection requirements based on information that recently became available. These program changes provide a more transparent view of the different reports and activities. ICs removed: Miscellaneous AO reporting, AO market report, AO price formula report and establishment of price for artitration negotiations. Miscellaneous reports, the Market Report, and Price Formula Report are combined into the Combined shared arbitration accounting report. Adjustments: the AO notification report, formerly under Miscellaneous reporting, is now submitted with the AO Annual Report. The Contract Arbitrator report was inadvertently not included in the previous submission and is now included.
