The purpose of this collection is to remove existing wireless microphone licensees from the 700 MHz band by June 12, 2010 (early clearing requirement). This spectrum will now be used by public safety entities such as police, fire, and emergency services. The second aspect of this IC requires manufacturers dealers, distributors, and other entities who sell or lease wireless mics to display a disclosure at the point of sale or lease that informs consumers of the conditions that apply to the operation of wireless mics that vacate the 700 MHz band and relocate to the core TV spectrum during the temporary waiver. Thirdly, the Commission established a labeling requirement for wireless mics capable of operating in the 700 MHz band. Any person who manufactures, sells, or leases wireless mics in the U.S. that are destined for non-U.S. markets and that are capable of operating in the 700 MHz band must include a label in all sales, marketing, and packaging materials, including on-line materials, related to such devices.

The Commission is reporting a program change of 1,049 hour decrease which is due to elimination of a June 12th early clearing requirement. The 120,300 hour increase in the number of responses is partially a correction to the previous estimate that was submitted to OMB. The previous number of responses should have been 129,600. We are now estimating 127,500 responses. The other reason is that the number of responses has decreased is due to fewer respondents (7,200 in February 2010 and 5,100 now in May 2010). The program change decrease is due to elimination of the early clearing requirement burden which will be unnecessary after June 12, 2010. The Commission is keeping the third party disclosure requirements (notification and labeling requirements) in this information collection and their associated burdens.
