Abstract: Section 112 (c)(3) of the CAA directs the Administrator to regulate area source categories accounting for 90 percent of the 30 listed urban hazardous air pollutants (HAP). Prepared feeds manufacturing was listed pursuant to the Integrated Urban Air Toxics Strategy Area Source Category List. The prepared feeds manufacturers potentially affected by the rule are facilities that produce feeds for large and small animals (except dogs and cats) and are covered under the North American Industrial Classification System (NAICS) code 311119. Regulation of this source category is necessary to ensure that area sources representing 90 percent of the emissions of chromium compounds and manganese compounds are subject to regulation. For prepared feeds facilities, the pelleting and pellet cooling operations are the primary sources of these HAP metal emissions. Section 112(d)(5) allows EPA to promulgate standards for area sources based on the maximum achievable control technology or generally available control technology or management practices (GACT). The standards for this source category are based on GACT. This final rule applies to all new and existing facilities that use chromium compounds and manganese compounds in their processes. We are subcategorizing facilities based on differences in production levels. Facilities with an average daily feed production rate exceeding 50 tons per day are "large" facilities, and those with an average daily feed production rate of 50 tons or less per day are "small" facilities. GACT consists of general management practices that apply in areas of the facilities where HAP are stored, used, or handled. For pelleting and pellet cooling operations in large facilities, GACT is the installation of cyclones. We are using particulate matter (PM) as a surrogate for chromium compounds and manganese compounds given that a correlation exists between PM and these compounds such that it is appropriate to rely on PM as a surrogate for these HAP and for their control.
