Respondents are owners or operators of coal preparation and processing plants that process more than 200 tons of coal per day. EPA is promulgating amendments to the new source performance standards for coal preparation and processing plants. These final amendments include revisions to the emission limits for particulate matter and opacity standards for thermal dryers, pneumatic coal cleaning equipment, and coal handling equipment (coal processing and conveying equipment, coal storage systems, and coal transfer and loading systems) located at coal preparation and processing plants which commence construction, modification, or reconstruction after April 28, 2008. The amendments also establish a sulfur dioxide emission limit and a combined nitrogen oxide and carbon monoxide emissions limit for thermal dryers located at coal preparation and processing plants which commence construction, modification, or reconstruction after May 27, 2009. Applicability of the thermal dryer standards is expanded such that the amended standards for thermal dryers apply to both direct contact and indirect contact thermal dryers drying all coal ranks and pneumatic coal-cleaning equipment cleaning all coal ranks. We are also amending the definition of coal for purposes of subpart Y to include coal refuse. Finally, the amendments establish work practice standards to control coal dust emissions from open storage piles located at coal preparation and processing plants.
The increase in burden is due to the additional performance testing, monitoring, recordkeeping, and reporting costs attributable to amendments to the subpart. It is also due to the use of more current labor rates for calculating the industry and Agency burden.
