The proposed rule will amend NRC regulations to improve decommissioning planning by its licensees who have operating facilities or who are required to have decommissioning financial assurance. A new section in 10 CFR 20.1406(c) and an amended section 20.1501(a) would require licensees to conduct their operations to minimize waste and to perform surveys of subsurface contamination. The amended regulations also would require licensees to report additional details in their decommissioning cost estimates, would eliminate two concurrently approved financial assurance mechanisms, and would modify the parent company guarantee and self-guarantee financial assurance mechanisms to authorize the Commission to make the amount guaranteed immediately due and payable to a standby trust if the guarantor is in financial distress. Finally, the amended regulations would require decommissioning power reactor licensees to report additional information on the costs of decommissioning and spent fuel management.
The proposed rule was entered into ROCIS under 10 CFR Part 30 (3150-0017) and upon OMB approval and publication of the final rule, the additional burden for the other regulations will be transferred from Part 30 to the correct regulation. This overall burden for this proposed rule is an estimated 1,814.5 hours of which the bulk of the burden (1,208.2 hrs) is captured under Part 30. The break down of the additional is as follows: Part 20 (3150-0014): 0 hours; Part 40 (3150-0020): 371.2 hours; Part 50 (3150-0011): 48 hours; Part 70 (3150-0009): 183.1 hours; and Part 72 (3150-0132): 4 hours. The burden hours captured in the previous statement all include the burden for 3rd party collection, which is an estimated 568 hours. The overall burden breakdown is 642.5 hours for reporting; 604 hours for recordkeeping and 568 hours for 3rd party, resulting in a total of 1,814.5 hours.
