Abstract: FCC rules under 47 CFR Section 2,803 permit the display and advertising of radio frequency (RF) devices prior to equipment authorization or other determination of compliance with the rules, provided that the advertising or display contains a conspicuous notice as specified by the subject rules. In addition, RF devices may only be offered for sale prior to equipment authorization to certain entities specified in Section 2.803(d), and the RF devices must be accompanied by a written notice that is disclosed to third parties that the equipemnt is subject to, and will comply with, the FCC rules prior to delivery.
