Abstract: These amended regulations offer five options for State/local agencies to accept delegation of the MACT standards. The State/local agency must demonstrate to the EPA that it has the ability to implement the MACT standards or the NESHAP in an effective manner. The amended regulations are different from the original regulations in that now all State/local agencies must use section 112(l) to accept delegation in any manner.
