New collection (Request for a new OMB Control Number)
The Telecommunications Act of 1996 allows the FCC, in certain cases, to forebear from enforcing its regulations. The FCC has begun a rulemaking in CC Dcket 96-61 that would eliminate the need for nondominant interexchange carriers to file tariffs, but would require a certification process. OMB strongly recommends that the FCC investigate potential mechanisms to provide consumers, State regulators, and other interested parties with some standardized pricing information. This information could be provided as part of the certification process or could be made available to the public in other ways.

The attached item proposes to eliminate the requirement that nondominant interexchange carriers file tariffs. In order to facilitate enforcement of such carriers' statutory obligation to charge just and reasonable and not unjustly discriminatory rates in the absence of tariff filings, the item proposes to require carriers to maintain at their premises business records to establish the lawfulness of their rates. The item proposes a certification requirement to implement the geographic rate averaging and rate integration requirements of the 1996 Telecommunications Act and seeks comment on an advertising.
