Abstract: THE INTERNAL REVENUE CODE REQUIRES BREWERS TO FILE A NOTICE OF INTENT TO OPERATE A BREWERY. ATF FORM 5130.10, BREWER'S NOTICE, IS SIMILAR TO A PERMIT TO OPERATE. LETTERHEAD APPLICATIONS AND NOTICES ARE NECESSARY TO IDENTIFY SPECIFIC ACTIVITIES THAT BREWERS ENGAGE IN, TO INSURE THE PROPOSED ACTIVITIES WILL NOT JEOPARDIZE FEDERAL REVENUES.
