Abstract: THE REGULATION ESTABLISHES RULES TO IMPLEMENT SECTION 904 (F). SECTION 904 (F) REQUIRES THAT A TAXPAYER SUSTAINING AN OVERALL FOREIGN LOSS MUST RECAPTURE SUCH LOSS IN SUBSEQUENT TAXABLE YEARS IN WHICH THE TAXPAYER CREDITS ITS FOREIGN TAXES. RECAPTURE IS ACCOMPLISHED BY TREATING A PORTION OF THE TAXPAYER'S FOREIGN SOURCE TAXABLE INCOME AS U.S. SOURCE INCOME.
