Abstract: RULE 45, ADOPTED APRIL 19, 1941, AND LAST AMENDED MARCH 25, 1981, PROVIDES THAT REGISTERED HOLDING COMPANIES AND THEIR SUBSIDIARIES SHAL NOT MAKE LOANS OR EXTEND CREDIT TO COMPANIES IN THE SAME SYSTEM WITHOU PRIOR COMMISSION APPROVAL EXCEPT IN CERTAIN CASES, TWO OF WHICH INVOLV REPORTING REQUIREMENTS: (A) EMERGENCY LOANS (17 CFR 250.45(B)(3), AND (2) TAX ALLOCATIONS (17 CFR 250.45(C). THE RULE IS NEEDED TO MONITOR THE LEVEL OF INTRA-SYSTEM LOANS.
