Abstract: COMPENSATION PAID TO NONRESIDENT ALIEN INDEPENDENT CONTRACTORS IS GENERALLY SUBJECT TO 30 PERCENT WITHHOLDING UNDER IRC SEC 1441. HOWEVER, SUCH COMPENSATION MAY BE EXEMPT FROM WITHHOLDING BECAUSE OF A U.S. TAX TREATY OR THE PERSONAL EXEMPTION AMOUNT. ALIEN INDIVIDUAL USES FORM 8233 TO REQUEST EXEMPTION. WITHHOLDING AGENT REVIEWS FORM A ACCEPTS IT OR NOT.
