Abstract: UNDER SECTION 1883 OF THE SOCIAL SECURITY ACT, THE AVERAGE STATEWIDE MEDICAID PAYMENTS FOR SNF AND ICF SERVICES DURING THE PREVIOUS CALENDA YEAR DETERMINE THE AMOUNT OF MEDICARE REIMBURSEMENT TO SWING-BED HOSPITALS. WHILE STATES AND HOSPITALS ARE ANXIOUS FOR HCFA TO IMPLEMENT THIS PROVISION, WE CANNOT DO SO UNTIL OBTAINING THE APPROPRIATE RATES FROM THE STATES. THE SAME RATES WOULD ALSO BE USED TO IMPLEMENT SECTION 1861(V)(1)(G) OF THE ACT.
